1) The amount of fees has been re-examined and increased and is now increasing according to the sought amount of the litigation.
On a purely illustrative basis, for proceedings before the Civil Court or the Commercial Court, fees will range from a minimum of 100.00 €, if the amount sought does not exceed 25,000.00 € to a maximum of 500.00 € if the amount sought exceeds 500,000.00 €.
However, there is an exception, claims related to the Family Court and the Family Division of the Court of Appeal that will be the object of a single and fixed fee.
2) Court fees will be paid and calculated for each applicant in proportion to their share in the amount sought.
This is significantly different compared to previous practice.
However, there is an exception, claims related to the Family Court and the Family Division of the Court of Appeal that will be the object of a single and fixed fee, whatever the number of claiming parties.
3) The claiming party must draw up a PRO FISCO statement when instituting the legal proceedings.
From now on, each claiming party must join to the document instituting the proceedings (PV, request,…) a pro fisco statement established according to the forms determined by royal decree indicating the estimated final amount sought referred to article 557 of the Judicial Code.
ATTENTION: If this pro fisco statement is not carried out, the Court will not receive the document instituting the proceedings (PV, request,…).
