Métiers de la construction : La question délicate des accès à la profession

Vous êtes indépendants dans un milieu de la construction ? Entrepreneur général ? Alors, on vous a sûrement déjà demandé si vous aviez vos accès à la profession mais qu’est-ce que cela signifie concrètement ?

Vous envisagez de céder les actions de votre société ? Attention aux liquidités excédentaires !

En cas de cession d’actions, le Trésor soutient régulièrement que les liquidités excédentaires de la société cible auraient dû préalablement être distribuées aux actionnaires personnes physiques et ainsi subir un précompte mobilier de 30 %.

Les donations mobilières notariées à l’étranger : Quel avenir ?

Hormis quelques exceptions, l’article 931 du Code civil impose de recourir à la forme notariée pour toute donation. Toutefois, seuls les actes notariés belges doivent faire l’objet d’un enregistrement (article 19 CDE) donnant lieu à la perception de droits de donation. Enfin, certains pays n’appliquent pas de droits de donation entre les non-résidents. C’est le cas de certains cantons suisses et des Pays-Bas.
